1. Scope
These Terms and Conditions apply to contracts for the short-term provision of City-House-Achern studios for purposes other than permanent residence and to related services.
For bookings made through Booking.com or other booking portals, the terms confirmed during the respective booking also apply. If cancellation or payment terms differ, the terms confirmed for the specific portal booking take precedence.
2. Contracting party and conclusion of the contract
The guest's contracting party is Kurtulus Acar, trading as City-House-Achern.
An accommodation contract is concluded as soon as a booking has been confirmed by City-House-Achern in writing or text form, or has been accepted as binding through a booking portal.
The guest must provide complete and accurate information when making the booking.
3. Prices and payment
The prices stated in the booking confirmation apply. The agreed prices include the services and taxes specified there.
Payment deadlines and permitted payment methods are set out in the respective booking confirmation or in the terms of the booking portal used.
Additional services or costs will be charged only if they have been agreed or have actually arisen as a result of a breach of duty for which the guest is responsible.
4. Use and occupancy
The studio may be occupied only by the number of persons stated in the booking and may not exceed the specified maximum occupancy.
Subletting, further letting or allowing unregistered overnight guests to use the studio is not permitted without the prior consent of City-House-Achern.
5. Cancellation of direct bookings
Direct bookings may be cancelled free of charge up to and including seven calendar days before the agreed arrival date.
For a later cancellation, 90 percent of the agreed total price may be charged as liquidated damages.
In the event of a no-show without prior cancellation, City-House-Achern is entitled to claim compensation for the loss actually incurred, up to 100 percent of the agreed total price.
Income from re-letting the studio and expenses saved will be credited. The guest expressly retains the right to prove that City-House-Achern suffered no loss or a substantially lower loss.
Cancellations must be made at least in text form, for example by email. The relevant time is when the cancellation is received by City-House-Achern.
For bookings made through external booking portals, the cancellation terms confirmed there take precedence.
6. No statutory right of withdrawal
Accommodation contracts that provide for a specific date or period generally do not carry a statutory fourteen-day right of withdrawal. The agreed cancellation terms remain unaffected.
7. Arrival and departure
Check-in is available from 3:00 p.m. on the arrival date. The studio must be vacated by 11:00 a.m. at the latest on the departure date.
Different times require prior arrangement. In the event of a late departure, the actual and verifiable additional costs incurred may be charged.
8. House Rules
The House Rules made available to the guest before conclusion of the contract form part of the accommodation contract, provided that the guest has agreed to their application. A copy provided at the accommodation serves as additional information.
All studios are non-smoking. Pets are permitted only by prior arrangement. Quiet hours from 10:00 p.m. to 7:00 a.m. must be observed.
9. Duty of care
The guest must treat the studio, its furnishings and all shared areas with care.
Damage, defects or other significant problems must be reported to the property management immediately. The guest may not commission necessary repairs without prior agreement.
The guest is liable in accordance with the applicable statutory provisions for damage culpably caused by the guest, accompanying guests or visitors.
10. Cleanliness and additional costs
The studio must be left clean and tidy. Rubbish and the guest's own food must be removed upon departure.
If there is excessive soiling, unauthorised smoking or culpably caused damage, the actual and verifiable costs of additional cleaning, repair or replacement may be charged.
11. Defects during the stay
Any defects or disruptions discovered must be reported to City-House-Achern immediately so that they can be remedied where possible.
The guest's statutory rights remain unaffected.
12. Serious breaches of contract
In the event of serious or repeated breaches of the accommodation contract or House Rules, City-House-Achern may take appropriate measures in accordance with the applicable statutory provisions and, where appropriate, terminate the contract for good cause.
This applies in particular to serious disturbances, unauthorised over-occupancy, smoking indoors, or the deliberate endangerment of persons or property.
13. Liability of City-House-Achern
City-House-Achern is liable in accordance with the applicable statutory provisions. Mandatory statutory claims, particularly those relating to injury to life, body or health and those arising from intentional or grossly negligent conduct, are not excluded or limited.
The statutory provisions apply to property brought onto the premises.
14. Data protection
Personal data is processed in accordance with the Privacy Policy published on the website and the applicable statutory provisions.
15. Final provisions
The law of the Federal Republic of Germany applies. Mandatory consumer-protection provisions remain unaffected.
If any provision of these Terms and Conditions is or becomes invalid, the applicable statutory provisions will apply in its place. The validity of the remaining provisions remains unaffected.
